Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Commr mobile application and the website at getcommr.com(collectively, the “Service”), operated by Archivia Technologies Inc.(“we”, “our”, or “us”).

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.


1. Eligibility

You must be at least 13 years old (or 16 years old in certain jurisdictions) to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.


2. Description of the Service

Commr is an AI-powered mobile application that helps users draft social media comments based on user-provided context, tone preferences, and post content. The Service generates suggestions for your review and does not automatically post any content on your behalf.

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice.


3. AI-Generated Content

The Service uses artificial intelligence to generate comment suggestions. You acknowledge and agree that:

  • AI-generated suggestions may be inaccurate, inappropriate, or not suitable for your intended purpose.
  • You must review all generated content before using it. Do not post AI-generated content without reading it first.
  • We do not guarantee that generated content will be factually accurate, professional, or appropriate for any particular context.
  • The quality of suggestions depends in part on the quality and accuracy of the information you provide.
  • Generated content does not constitute legal, professional, financial, or other expert advice.

4. User Responsibility and Content

You are solely responsible for:

  • Any content you submit to the Service (post text, context, voice profile).
  • Any content you choose to copy, edit, and publish based on generated suggestions.
  • Ensuring that your use of generated content complies with the terms of the social media platform you post on.
  • Ensuring that your published content complies with all applicable laws and regulations.
  • Any consequences, reactions, or outcomes arising from your published content.

Commr does not access your social media accounts, post content on your behalf, or interact with any platform automatically.


5. Acceptable Use

You agree not to use the Service to:

  • Generate content that is harassing, abusive, defamatory, threatening, discriminatory, or otherwise harmful.
  • Spam, flood, or artificially inflate engagement on social media platforms.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Generate content that infringes any third party's intellectual property, privacy, or other rights.
  • Attempt to circumvent, disable, or interfere with the security or integrity of the Service.
  • Use the Service in violation of any applicable law or regulation.
  • Reverse engineer, decompile, or extract source code from the application.
  • Use the Service for commercial scraping or bulk data collection.

We reserve the right to suspend or terminate accounts that violate these acceptable use guidelines.


6. Subscriptions and Credits

Commr offers a free trial and paid subscription plans. Subscriptions provide a set number of comment generation credits per billing cycle.

  • Free trial: New accounts receive a limited number of free generations. Trial credits do not roll over.
  • Paid subscriptions: Billed monthly through the Apple App Store or Google Play Store. Credits are refreshed at the start of each billing period and do not carry over to the next cycle.
  • Pricing: Subscription prices are displayed in the app and on our website. We reserve the right to change pricing at any time, with notice to existing subscribers.
  • Taxes: Prices may be subject to applicable taxes depending on your location.
  • No refunds: All purchases made through the App Store or Play Store are subject to the respective platform's refund policy. We do not offer refunds directly for subscription fees or unused credits.

7. Cancellation

You may cancel your subscription at any time through the Apple App Store or Google Play Store subscription settings. Cancellation takes effect at the end of the current billing period. After cancellation, you retain access to paid features until the end of the period for which you have already paid.

We may suspend or terminate your account if you breach these Terms. In the event of termination for cause, no refund will be issued.


8. Intellectual Property

The Service, including its design, code, trademarks, and original content, is owned by Archivia Technologies Inc. and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without our written permission.

Content you generate using the Service is based on your inputs. You retain ownership of the input content you provide. Generated suggestions produced by the Service are provided to you for personal, non-commercial review and use.


9. No Auto-Posting

Commr does not post content to any social media platform on your behalf. The Service does not request, store, or use credentials for any social media platform. All publishing decisions and actions are taken by you, independently, after reviewing content generated by the Service. You are solely responsible for what you post and where you post it.


10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

  • Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
  • That the Service will be uninterrupted, error-free, or free of harmful components.
  • That any AI-generated content will be accurate, appropriate, or suitable for any purpose.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARCHIVIA TECHNOLOGIES INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or business opportunities.
  • Loss of data or content.
  • Damages arising from your use or inability to use the Service.
  • Damages arising from reliance on AI-generated content.
  • Reputational harm resulting from content you choose to publish.

Our total cumulative liability to you for any claims arising from your use of the Service shall not exceed the greater of (a) the amounts you paid us in the twelve months preceding the claim, or (b) USD $50.


12. Indemnification

You agree to indemnify, defend, and hold harmless Archivia Technologies Inc. and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.


13. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada for the resolution of any disputes arising from these Terms or your use of the Service.


14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. If changes are material, we will notify you by email or in-app notice. Your continued use of the Service after updated Terms are posted constitutes your acceptance of the new Terms.
