Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Commr mobile application and the website at getcommr.com (collectively, the “Service”), operated by Archivia Technologies Inc.(“we”, “our”, or “us”).

By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.


1. Eligibility

You must be at least 13 years old, or the applicable minimum age required in your jurisdiction, to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.


2. Description of the Service

Commr is an AI-powered application that helps users draft social media comment ideas based on user-provided post content, context, tone preferences, and personalization settings.

The Service generates suggestions for your review. Commr does not automatically publish comments or other content to social media platforms on your behalf.

We may modify, improve, suspend, or discontinue all or part of the Service from time to time, subject to applicable law.


3. AI-Generated Content

The Service uses artificial intelligence to generate comment suggestions. You acknowledge and agree that:

  • AI-generated suggestions may be inaccurate, incomplete, inappropriate, or unsuitable for your intended purpose.
  • You are responsible for reviewing all generated content before using or publishing it.
  • The Service is designed to assist your writing and does not replace your own judgment.
  • We do not guarantee that generated content will be factually accurate, professional, appropriate, or suitable for any particular context.
  • The quality of suggestions depends in part on the quality and accuracy of the information you provide.
  • Generated content does not constitute legal, medical, financial, professional, or other expert advice.

4. User Responsibility and Content

You are solely responsible for:

  • Any content you submit to the Service, including post text, context, profile information, tone preferences, and other personalization information.
  • Any generated content you choose to edit, copy, save, share, or publish.
  • Ensuring that your use of generated content complies with the terms and policies of the social media platform where you use it.
  • Ensuring that your submitted and published content complies with applicable laws and regulations.
  • Any consequences, reactions, or outcomes arising from content you choose to publish.

You represent that you have the necessary rights, licenses, permissions, or other lawful basis to submit any content you provide to the Service, including text copied or shared from third-party platforms.

Commr does not access your social media accounts, publish content on your behalf, or interact with social media platforms automatically.


5. Acceptable Use

You agree not to use the Service to:

  • Generate or distribute content that is unlawful, abusive, defamatory, threatening, discriminatory, harassing, or otherwise harmful.
  • Spam, flood, manipulate, or artificially inflate engagement on social media platforms.
  • Impersonate any person or entity or misrepresent your identity or affiliation.
  • Generate or submit content that infringes any third party's intellectual property, privacy, publicity, or other rights.
  • Attempt to circumvent, disable, disrupt, or interfere with the security or integrity of the Service.
  • Use the Service in violation of any applicable law or regulation.
  • Reverse engineer, decompile, or attempt to extract source code from the application except where permitted by applicable law.
  • Use the Service for unauthorized scraping, bulk data collection, or automated abuse.
  • Attempt to exploit referral, subscription, credit, or promotional systems through fraudulent or misleading activity.

We may suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive activity.


6. Subscriptions and Credits

Commr offers free credits and optional paid subscription plans. Paid subscriptions provide a set number of comment generation credits during each billing cycle.

  • Free credits: New accounts may receive a limited number of complimentary credits to try the Service. Free credits do not roll over unless otherwise stated.
  • Paid subscriptions: Subscriptions are billed through the applicable app store, such as the Apple App Store or Google Play Store. Subscription credits refresh according to the applicable billing cycle and do not carry over unless otherwise stated.
  • Pricing: Subscription prices are displayed within the app, and purchases are processed through the applicable app store. Any pricing changes will be handled in accordance with applicable app store policies and law.
  • Credit top-ups: Eligible users may purchase additional one-time credit packs through the applicable app store. Purchased credits are added to the user's account after successful purchase verification.
  • Taxes: Prices may be subject to applicable taxes depending on your location and the policies of the applicable app store.
  • Refunds: Purchases made through the Apple App Store or Google Play Store are subject to the applicable platform's billing and refund policies. We do not directly process refunds for purchases made through those platforms.

7. Cancellation and Subscription Management

You may manage or cancel your subscription through the subscription settings of the applicable app store, such as the Apple App Store or Google Play Store.

Cancellation generally takes effect at the end of the current billing period. Unless otherwise required by applicable law or platform policy, you will retain access to paid features through the end of the period for which you have already paid.

If your account is suspended or terminated because of a violation of these Terms, refunds remain subject to the policies of the applicable app store.


8. Intellectual Property

The Service, including its software, code, design, branding, trademarks, graphics, and original content, is owned by Archivia Technologies Inc. or its licensors and is protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, sell, license, or exploit any part of the Service except as expressly permitted by these Terms or applicable law.

You retain ownership of the content you submit to the Service. Subject to these Terms and applicable law, you may use generated suggestions in your own social media content. You remain responsible for reviewing and deciding whether to publish any generated suggestion.


9. Referral Program

We may offer referral programs that allow eligible users to earn promotional credits or other benefits when qualifying referral requirements are met.

  • Referral credits and promotional rewards have no cash value and cannot be redeemed for cash.
  • Referral rewards may be subject to eligibility requirements, limits, expiration rules, or other conditions communicated within the Service.
  • Self-referrals, duplicate accounts, fraudulent referrals, or attempts to manipulate the referral program are prohibited.
  • We may withhold or revoke referral rewards that we reasonably believe were obtained through fraud, abuse, or violation of these Terms.
  • We may modify, suspend, or discontinue referral programs or promotional rewards at any time, subject to applicable law.

10. No Auto-Posting

Commr does not post content to social media platforms on your behalf. The Service does not request, store, or use your social media account credentials for the purpose of publishing content. All publishing decisions and actions are taken by you after reviewing content generated by the Service. You are responsible for what you choose to publish and where you publish it.


11. Account Deletion

You may delete your account directly from within the Commr app or contact us at support@getcommr.com for assistance.

Account deletion is handled in accordance with our Privacy Policy. Certain limited information may be retained where reasonably necessary to comply with legal obligations, maintain financial records, prevent fraud, protect the security of the Service, resolve disputes, or enforce agreements.


12. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

  • Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
  • That the Service will be uninterrupted, error-free, secure, or free of harmful components.
  • That any AI-generated content will be accurate, appropriate, complete, or suitable for any particular purpose.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ARCHIVIA TECHNOLOGIES INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or business opportunities.
  • Loss of data or content.
  • Damages arising from your use of or inability to use the Service.
  • Damages arising from reliance on AI-generated content.
  • Reputational harm resulting from content you choose to publish.

To the maximum extent permitted by applicable law, our total cumulative liability to you for claims arising from your use of the Service shall not exceed the greater of (a) the amounts you paid in connection with the Service during the twelve months preceding the claim, or (b) USD $50.


14. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Archivia Technologies Inc. and its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from your use of the Service, your violation of these Terms, or your violation of third-party rights.


15. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Subject to any rights you may have under applicable consumer protection law, disputes arising from these Terms or your use of the Service shall be subject to the jurisdiction of the courts located in Ontario, Canada.


16. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. If changes are material, we may notify you by email or through the Service where appropriate. Your continued use of the Service after updated Terms become effective constitutes your acceptance of the revised Terms.
